The P38S form is no longer in use with HMRC. It used to be available so that employers could pay students who were working for them, without deducting tax. The exemption was retired in 2013.

What was P38s used for?

Students often work part-time for an employer during their holidays from school, college or university. It was possible to be able to work part-time in the holiday periods, and not have income tax deducted by completing a form P38S – a student exemption form. However, Real Time Information (RTI) became compulsory for all employers from 6th April 2013 and the form P38S was withdrawn.

Students are now treated the same as other employees as part of the PAYE process.
