The business name of a company is one of the most important assets a business can have. The reputation of the business is strongly associated with the company name, providing instant recognition, which is why you don’t want another company using the same name.

If the company name has a strong association to the particular goods or services provided by your business, it may be possible to take legal action against any other company using the same name in a similar field. It is also advisable to register the company name as a trade mark, as this offers a business extra legal protection.

If you are considering a business website, you will want to purchase and register a domain name which incorporates a trade mark or company name. However, if you have a trade mark, this doesn’t give you the automatic right to a domain name including your trade mark. The domain name you want may have already been registered by another business.

If someone is using a domain name to make people believe, falsely, that their goods or services are actually yours, you could take legal action. You may also be able to take action if someone has registered your trade mark or company name as a domain name with the sole intention of selling it back to you. It is advisable to register the company name as a trademark, which offers protection for a limited amount of time, before being renewed periodically.
