When someone is called up for jury service, there isn’t much that gets them off the hook for attending. This means that employers are obliged to allow employees time off so they can serve. But, employers are not required to pay employees while they are on jury duty, though many do choose to do so anyway.

Employees and jury service

The courts will provide jurors with a Certificate of Loss of Earnings. Employees can use this to reclaim their earnings, though there is a maximum daily rate that they can reclaim.

Though employers are not obliged to pay any loss of earnings, some choose to ‘top-up’ the amount for employees who earn more than the maximum amount they can claim from the court.

Continuing to pay a complete wage to an employee doesn’t require any changes to payroll. However, if an employer pays a top-up amount to the court reimbursement, it requires careful calculation. The loss of earnings payment paid by the court is not liable to PAYE tax and National Insurance, as it is classed as a compensation payment.
